Les « enfants de la Creuse ». Pour une analyse critique de la justice transitionnelle

Abstract : Can investigating the resettlement of minors of Reunionese origin be seen as an exercise in transitional justice ? The answer to this question can only raise doubts and reservations for a number of reasons. These are primarily related to the scope of individual and collective trauma compared to the low level of popular appropriation of this societal issue on Reunion Island, the limited questioning of this issue for the operationality and reproduction of Reunion society, and the lack of debate within Reunion society and within the University of Reunion Island… The French state is not comfortable with transitional justice. It does not correspond with its history, nor its future trajectory. Our article aims to demonstrate that the temporary committee for information and historical research on the displacement of Reunionese children to Metropolitan France between 1963 and 1982 does not meet the requirements of transitional justice. This was not its purpose ; this could not become its objective unless it failed to respect its historical mission. A phase of justice should be opened to question the existence or not of a legal responsibility of the state, in the form of a second, final and definitive commission. The general principles of transitional justice must be mobilised. This phase is lacking for victims and hinders collective and often individual resilience. These general principles would make it possible to reach a truth in order to build resilience which is not, as it stands, built on sufficiently solid collective foundations.
